TERMS AND CONDITIONS

 

Orders are accepted under the following terms & conditions. These terms and conditions will be governed and construed in accordance with the laws of England and Wales. They form the basis of a contract between the person or company (the Customer or You) purchasing the goods from Force 4 Enterprise Ltd trading as Fosy Originals in England and Wales as a Company.

VAT

Where applicable VAT will be charged at 20%. A VAT invoice can be supplied on request.

COLLECTION and DELIVERY

Delivery for all products in stock will be made within 5-7 working days from the date of the order.  If for any reason a product is out of stock, we will notify you of this within 3 days of your order, offering you an alternative item and notifying you of when your preferred item will be in stock.  If neither of these options are suitable, your payment will be returned in full including delivery charges.

All orders are dispatched by Royal Mail unless otherwise specified.

Unfortunately, we do not currently offer shipping to the following countries:

Belarus, Burma/Myanmar, Democratic Republic of Congo, Eritrea, Federal Republic of Yugoslavia & Serbia, International Criminal Tribunal for the Former Yugoslavia, Iran, Iraq, Ivory Coast, Lebanon and Syria, Liberia, North Korea (Democratic People's Republic of Korea), Republic of Guinea, Somalia, Sudan, Zimbabwe, Cuba, Balkans.

Customers can collect their items and make payment at the same time if they so wish. Please call beforehand to ensure that someone will be able to assist you. If we are delivering the items, they will be despatched by our nominated courier company. Please be aware that courier companies are not 100% reliable. The Company accepts responsibility for ensuring your order is received by the courier company, and that their paperwork is completed accurately.  However, we do not accept responsibility for errors made by courier companies. If the package arrives showing signs of damage for which the courier may be responsible, please make a note and photograph the damage, as this may be used in a claim at a later date.  

In the event that a booking has been made with the buyer but the delivery company arrives to find that there is no-one to accept delivery, the buyer will be responsible for any re-delivery charges and the goods will not be released from the carrier's depot until such fees have been paid to the seller.  Please note that any delivery which involves a water crossing will incur additional charges as will deliveries to some of the more remote areas of the British Isles. We always pass these charges on to the buyer at our cost + VAT.  If you are unsure about how much delivery will be then contact us before making your purchase as we will insist on payment of these additional charges before shipping the goods.

PAYMENT TERMS

For non-trade sales the Company will require cleared funds prior to the despatch of goods. We accept payment by cash in person, cheque (we require 7 days for cheques to clear before we can release goods), BACS (ask for bank details), and all major credit cards (either in person or card holder not present).  Please make cheques payable to Force 4 Enterprise Ltd. We cannot accept liability for any monies sent but not received. If payment of an item won at auction is not received within 3 days of the ending of the auction we reserve the right to sell the item to another buyer and we are released from any obligation to provide the item at the sale price. Trade sales are subject to approval by our credit referral agency. In the case of a zero credit limit we will require cleared funds prior to despatch of goods. Payment terms for credit account customers are strictly 30 days from date of invoice. Credit terms cannot be applied for until 3 successful orders have been processed. We reserve the right to charge interest under The Late Payment of Commercial Debts (Interest) Act 1998 on overdue accounts.

PACKING AND TRANSPORT

We will ensure that all orders are packaged in a way suitable to the product and the method of despatch. Where the item size determines that the delivery must be palletised please be aware that a 17 ton vehicle may well be used. If there are any vehicular restrictions that will prevent delivery being made it is your responsibility to inform us so that alternative arrangements can be made. Palletised deliveries will be delivered as close to your property as access allows with a pallet truck. In order for us to process any insurance claim the item must be checked on delivery.  Any delivery that is signed for either without checking or as 'unchecked' will invalidate the returns procedure and insurance.

LIABILITY

We accept no liability for any damages to property as a result of incorrect use and or fitting of our products. We accept no liability for delays that may be caused due to an item being out of stock or a delivery being delayed due to issues related to the carriage.

QUALITY

We do our very best to ensure the quality of all our materials and finishing.  However, due to the nature of faux fur, some shedding may occur.  We have tested the materials and are confident that the small degree of shedding will not affect the durability or look of the products.  There may also be a small variation in the colour of the faux fur, compared to the images shown on our website.  If you feel that an item is not as described, please return it according to the terms of our Returns Policy.

We are constantly updating our product range so please be aware that some products may change from time to time without notice.  If you have a particular specification (for example, size of helmet) in mind and are unsure whether a product is suitable, please always contact us first to make sure that the item is as you expect.
